Intellectual Property and Non-Affiliation Policy

1. Independent Brand. The PMGN Bookstore ("Company," "we," "us," or "our") is an independently owned and operated fan merchandise brand organized under the laws of the State of Georgia. The Company is not affiliated with, licensed by, authorized by, endorsed by, or in any way sponsored by the University of Georgia ("UGA"), the University of Georgia Athletic Association, Inc. ("UGAA"), the University System of Georgia, or any collegiate licensing organization or agent acting on their behalf. No university official has authorized or approved any product sold by the Company.

2. Fan-Originated Phrase. The phrase "Them Dawgs is Hell," as used in Company products, is a vernacular fan call-and-response expression that originated organically in the University of Georgia fan community. The Company did not copy this phrase from any registered trademark of UGA or UGAA. The Company asserts that this phrase, as used on apparel sold by the Company, constitutes expressive fan speech and is not used as an indicator of university origin, sponsorship, or endorsement. To the extent this phrase or any substantially similar expression is or becomes the subject of a trademark registration held by any third party, the Company expressly preserves all rights and defenses available under federal and state law, including without limitation the defenses of: (a) failure to function as a source identifier for goods (TMEP § 1202.04(b)); (b) ornamental use (TMEP § 1202.03); (c) fair use, both classic descriptive fair use under 15 U.S.C. § 1115(b)(4) and nominative fair use; (d) First Amendment protection for expressive or fan-cultural speech; and (e) independent origination.

3. No University Marks Used. No product sold by the Company bears any federally registered or state-registered trademark, service mark, design mark, logo, seal, mascot image, or official graphic indicia of UGA, UGAA, or any affiliated entity. The absence of official marks is intentional and is not inadvertent.

4. No Concession of Rights. Nothing in these terms, in any Company disclaimer, or in any Company communication constitutes (a) an acknowledgment that any third party holds valid and enforceable rights in the phrase "Them Dawgs is Hell" or any portion thereof; (b) an admission that use of any fan expression by the Company creates a likelihood of confusion, mistake, or deception as to source, sponsorship, or endorsement; or (c) a waiver of any First Amendment, fair use, failure-to-function, or other defense the Company may assert in any proceeding.

5. Third-Party Marks. All trademarks, service marks, and trade dress of the University of Georgia, the University of Georgia Athletic Association, and other third parties are the property of their respective owners. Their appearance or reference in Company content is solely for informational and expressive identification purposes and does not imply any affiliation with or endorsement by those parties.

6. Enforcement and Notice. If you believe that any Company product infringes any intellectual property right, please contact ryan@thepmgn.com with a detailed written statement. The Company will review all such notices in good faith consistent with applicable law.
